Terms of service

These are the terms on which we sell artwork, prints, studio time and workshops through louiseclark.art and at The Imperfect Circle studio. Buying from us means you agree to them. They do not affect your legal rights as a consumer.

Who you are buying from

Louise Clark Art and The Imperfect Circle are trading names of Cassette Creations Ltd, company number 16100448, registered office Suite 2-B, Point East, Park Plaza, Cannock, Staffordshire, WS12 2DB, United Kingdom. VAT number GB502846307. That is the name you will see on your card or PayPal statement. The studio is at Pod 3, The Eco Centre, Home Farm, Screveton, Nottinghamshire, NG13 8JL, United Kingdom. Prices and payment

All prices are in pounds sterling and include VAT at the current rate. The price you see is the price you pay, plus any delivery charge shown at checkout. Payment is taken in full when you order. We may change prices at any time, but not for an order you have already placed.

Original artwork and prints

Each original is one of a kind; once it is sold it is gone. Prints are made to order by our printing partner, usually in the country they are going to, and sent directly to you. We aim to dispatch originals within five working days and prints within the time shown at checkout. Delivery times are estimates.

Changing your mind about a print. You have 14 days from the day it arrives to tell us you don't want it. Email us and we will refund you in full, including standard delivery. We won't usually ask for the print back; keep it or pass it on.

Changing your mind about an original. You have 14 days from the day it arrives to tell us, and a further 14 days to send it back. Email us first and we will confirm the details. Send it to Louise Clark, The Imperfect Circle, Pod 3, The Eco Centre, Home Farm, Screveton, Nottinghamshire, NG13 8JL, United Kingdom, in its original packaging, by a tracked and signed-for service, with a note of your name and order number inside, and email us the tracking number. You pay the return postage, and the piece is your responsibility until it reaches us, so insure it for what you paid. We refund the price and standard delivery within 14 days of getting it back, less any loss in value caused by handling beyond what you would do in a shop, or by poor packing.

Damaged or faulty. Tell us within 30 days of delivery, with a photograph, and we will replace it or refund you, at no cost to you and without needing it back. Colours vary between screens and paper, and between one print run and the next; that is the nature of the thing rather than a fault.

Copyright. Buying a piece of art or a print does not buy the copyright, which stays with Louise Clark. You may not reproduce the work without written permission.

Delivery outside the UK

We are happy to send originals and prints abroad. Prices are in pounds sterling and any currency conversion is done by your card provider at their rate. If you are outside the UK, your country may charge import duty or tax when the parcel arrives; that is for you to pay, and we cannot predict it. If you return something to us from outside the UK, please mark the parcel as returned goods so it isn't charged on the way in. Nothing in these terms takes away rights you have under the law of the country you live in.

Workshops and studio time

A workshop seat or a private booking is for a specific date and time. Because it is a leisure service on a fixed date, the 14-day right to cancel that applies to most online purchases does not apply to it (Consumer Contracts Regulations 2013, regulation 28(1)(h)). Instead:

• Moving your date. You can move to any other available date free of charge up to 48 hours before your session. Reply to your confirmation email and we will swap it.
• Passing on your seat. Your seat is transferable. If you can't come, send someone in your place; just let us know their name.
• Inside 48 hours, or not turning up. The seat is lost and we cannot refund it. If something has gone badly wrong, write to us; we are human.
• Small groups. Workshops have four seats and need two booked to run. If you are the only booking two days before, we will email you and you can choose: move to another date at no cost, or come anyway. The studio stays open during workshops, so you may have company from whoever wanders in.
• If we cancel. If we have to cancel a session, through illness, weather or anything else on our side, you choose a full refund or a free transfer to another date. That is the limit of what we owe you; we are not liable for travel or other costs you have incurred.
• Who can come. Workshops are for adults. 16 and 17-year-olds are welcome with an adult who is also taking part. Younger children may sit at the table on studio days with an adult, one child per adult.
• Safety. We use hot pans and plant materials. Please follow the instructions you are given on the day, tell us about any allergy or health condition we should know about, and wear clothes that don't mind ink. Nothing we make is for eating or drinking.
• Photographs. We sometimes take photographs and video during sessions. We will ask you on the day; say no and you won't be in them.

Studio seats paid on the day

Studio time paid for at the table (an hour, a morning, a day) is for that day and is not refundable once you have sat down. Materials are provided for use at the table.

Gift cards

Gift cards, when we offer them, can be spent on anything we sell and are valid for the period stated on the card. They cannot be exchanged for cash.

Our liability

Nothing in these terms limits our liability for death or personal injury caused by our negligence, or for anything else the law says we cannot limit. Otherwise, our liability to you for any order or booking is limited to the amount you paid for it. We are not responsible for losses that were not foreseeable when you bought from us.

Events beyond our control

If something outside our reasonable control stops us fulfilling an order or running a session, we will tell you as soon as we can and either reschedule or refund.

The website

Everything on this website, including the artwork, photographs and words, belongs to Louise Clark or Cassette Creations Ltd and may not be copied without permission. We try to keep the site accurate but cannot promise it is free of errors; if we have made an obvious mistake in a price we will tell you before we accept your order.

The law

These terms are governed by the law of England and Wales, and the courts of England and Wales have jurisdiction. If you live elsewhere in the UK you may also bring a claim in your local courts.
